1. Introduction & Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the When I Croak website, application, and related services (collectively, the "Service"), provided by When I Croak ("we," "us," "our," or "the Company").

By creating an account, purchasing a plan, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Description of the Service

When I Croak helps you organize financial, personal, and household information into a structured "life map," and provides tools to grant designated trusted contacts access to that information under conditions you control. The Service includes an AI-powered feature, The Guide, that assists trusted contacts during activation.

The Service is an organizational and informational tool. It is not a substitute for a will, trust, power of attorney, or other legal estate-planning document, and it does not constitute legal, financial, tax, or insurance advice.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your login credentials.

5. Trusted Contacts & Activation

You are solely responsible for identifying, designating, and configuring the access permissions of your trusted contacts, and for the accuracy of any activation conditions you set. We provide the tools to manage this access, but we do not independently verify the identity, intentions, or relationship of any trusted contact you designate, beyond the identity verification and multi-factor authentication steps built into the Service.

Once a trusted contact's access is activated in accordance with your account settings, we are not responsible for how that individual uses the information in your map.

6. The Guide (AI Companion)

The Guide generates guidance, scripts, and drafted communications based on the content of your map and general information about executor and survivor processes. Outputs from The Guide are provided for informational and organizational purposes only. The Guide is not a lawyer, accountant, insurance agent, or financial advisor, and its outputs should not be relied upon as professional advice. You and your trusted contacts remain responsible for verifying any information before acting on it, including before making legal, financial, or medical decisions.

7. Plans, Pricing & Payment

We offer multiple plans (currently The Map, The Living Map, and The Legacy), each with its own one-time and/or recurring fees as described on our pricing page at the time of purchase. Recurring plans renew automatically at the then-current rate unless cancelled prior to the renewal date. Prices are subject to change; we will provide notice before any change affects an active subscription.

Payments are processed securely by our third-party payment processor, Stripe. We do not store your full payment card details on our servers.

8. Refunds & Cancellation

We offer the following refund windows from the date of purchase, provided the request is made within the applicable period:

14-day refund window
The Legacy
30-day refund window

Refund requests outside these windows will be evaluated on a case-by-case basis at our discretion. Annual renewal fees for The Living Map and The Legacy are non-refundable once the renewal period has begun, except as required by applicable law. You may cancel a recurring plan at any time from your account settings; cancellation will take effect at the end of the current billing period.

9. Your Content & Responsibilities

You retain ownership of the information and content you enter into your life map ("Your Content"). You grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you and your designated trusted contacts.

You are responsible for the accuracy of Your Content. As described in our Privacy Policy, you agree not to enter sensitive credentials such as account passwords, full account numbers, or Social Security numbers into the Service.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to another user's account or map
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated means to scrape or extract data from the Service without our written consent
  • Misrepresent your identity or your authority to act as, or designate, a trusted contact

11. Affiliate & Advisor Program

Financial professionals and advisors who participate in our affiliate program agree to the commission structure and terms communicated at the time of enrollment, including commission rates on referred setup fees and annual renewals. We reserve the right to modify, suspend, or terminate the affiliate program, or an individual affiliate's participation, at our discretion, including in cases of misrepresentation or violation of these Terms.

12. Intellectual Property

The Service, including its design, software, text, graphics, and The Guide, is owned by When I Croak or its licensors and is protected by intellectual property laws. Except for Your Content, nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

The Service, including outputs from The Guide, does not constitute legal, financial, tax, medical, or insurance advice. You should consult a qualified professional for advice specific to your circumstances.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHEN I CROAK AND ITS OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold When I Croak harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your designation of trusted contacts, or your violation of these Terms.

16. Termination

You may close your account at any time from your account settings. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or unlawful activity, or for any other reason with reasonable notice where practicable. Upon termination, your right to use the Service will cease, subject to our data retention practices described in the Privacy Policy.

17. Governing Law & Disputes
